Terms of Service

Welcome to KeepCare. By using keepcare.net (the "Service") you agree to these Terms. If you don't agree, don't use the Service.

1. What KeepCare is (and isn't)

KeepCare is a curated marketplace that helps people discover preventative and holistic care and connect with practices. KeepCare is not a healthcare provider, does not provide medical advice, and does not practice medicine. Using the Service does not create a doctor–patient relationship with KeepCare. KeepCare is not a party to any agreement, appointment, or treatment between you and a practice.

2. Not medical advice; emergencies

Content on KeepCare (including condition information and any cited evidence) is for general education only and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified professional with questions about a medical condition. If you have a medical emergency, call 911 or your local emergency number.

3. Practitioner listings

We personally review and hand-pick each practice we list. We do not verify or monitor any practitioner's licence. Acupuncturists are responsible for holding and maintaining a valid licence, and the California Acupuncture Board regulates and enforces licensure. We present each practice's information in good faith but do not guarantee the licensure status, accuracy, availability, qualifications, or outcomes of any practice, and we do not endorse or warrant any practice's services. Your decision to engage a practice is your own; do your own due diligence, including confirming a practitioner's current licensure and credentials before booking. Listing is currently free, and no practice has paid to be listed or paid for a better position. If we introduce paid features in future we will update these terms and say clearly what is paid.

4. Booking

When you choose to book with a practice, KeepCare directs you to that practice's own website or booking system. KeepCare does not schedule, confirm, modify, or cancel appointments, does not process payments, and is not a party to any appointment or the care provided. The practice is solely responsible for its scheduling, fees, cancellations, and services, on its own terms. Confirm details directly with the practice.

5. Sharing and referrals

If you use a feature to share or recommend a practice, don't use it to send spam, and don't share another person's contact details unless you have their permission to do so. If a feature sends a message on your behalf, it will identify you as the sender and offer an easy way to opt out. We may limit or remove access to sharing features for misuse.

6. No health information

KeepCare's forms use a fixed list of condition categories and are not for medical details. Do not submit symptoms, health history, or other clinical information through the Service.

7. Acceptable use

Don't misuse the Service. Specifically, don't do any of the following without our written permission:

• Copy, extract or store a substantial part of the practice listings, taxonomies or summaries, whether in one go or bit by bit over time.
• Use any automated means (crawlers, scrapers, headless browsers, extraction scripts) to collect content from the Service, except as allowed in section 7a.
• Build, train or improve a competing directory, dataset or product using content taken from the Service.
• Resell, redistribute or sublicense any part of the Service.
• Place an unreasonable load on the Service, or try to get around rate limits or access controls.
• Use the Service for anything unlawful, deceptive, harmful or infringing, impersonate anyone, or try to reach data that isn't yours.

We may suspend or block access for any of the above.

7a. Search engines and AI assistants

KeepCare is built to be read by search engines and AI assistants, and we want them to use it.

You may crawl, index, retrieve from and quote the Service in order to answer a person's question, including in an AI assistant's answer, provided you respect robots.txt, identify the source as KeepCare, and link to the page you used. llms.txt sets out what we consider fair use of this site.

What is not permitted is bulk extraction: copying the listings or taxonomies wholesale, storing them as a dataset, or using them to build or train a competing directory or recommendation product. The difference is between citing us and replacing us.

8. Intellectual property

8.1 What KeepCare owns

The Service, including its design, page structure, written content, condition and modality taxonomies, practice summaries, and the selection, categorisation and arrangement of the practices listed, is owned by KeepCare and protected by copyright as an original compilation. Individual facts about a practice are not owned by anyone. The way KeepCare selects, organises and presents them is.

KeepCare, the KeepCare logo, and the cradled-heart mark are trademarks of KeepCare. You may not use them in a way that suggests KeepCare endorses you, your business, or your products.

We grant you a limited, personal, revocable, non-transferable licence to use the Service for its intended purpose: finding and contacting a practice. No other right is granted.

8.2 What belongs to practices and other people

Practice names, logos, photographs, taglines and other brand materials belong to those practices. KeepCare displays them to identify and describe the practice, which is a descriptive use, not a claim of ownership, sponsorship or affiliation.

Reviews shown on KeepCare are written by the people who wrote them and are reproduced in excerpt with their source named. KeepCare does not write, edit or commission reviews.

8.3 If you are a practice and want something changed or removed

Listing on KeepCare is currently free and no practice has paid for its position. Practices are listed from publicly available information and are welcome to leave.

Email [email protected] and we will correct or remove your page, including your logo and any photographs, the same business day where we can. You do not need to give a reason.

8.4 Material you send us

If you send us a correction, a recommendation, a testimonial, or any other content, you give KeepCare a non-exclusive, worldwide, royalty-free licence to use, display and adapt it on the Service and in materials about the Service. You keep ownership of it. If you later want it removed, email us and we will remove it going forward.

9. Third-party links

The Service links out to practices' own sites and booking systems. We are not responsible for third-party sites or services; their terms and privacy practices are their own.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that listings are complete or current.

11. Limitation of liability

To the fullest extent permitted by law, KeepCare and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any damages arising from your use of the Service or from any interaction with a practice. Our total liability for any claim will not exceed USD $100.

12. Indemnification

You agree to indemnify and hold KeepCare harmless from claims arising out of your use of the Service, your content or referrals, or your violation of these Terms.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Venue for disputes is San Diego County, California.

14. Changes

We may update these Terms; we'll change the effective date and, for material changes, provide notice on the Service. Continued use means you accept the changes.

15. Reporting copyright infringement

If you believe material on KeepCare infringes your copyright, see our copyright and takedown policy for how to send a notice and who to send it to. We respond to valid notices and remove or disable access to infringing material.

16. Termination

We may suspend or end your access to the Service at any time, for any reason, including a breach of these Terms. Sections 8, 10, 11, 12, 13, 16 and 17 survive any termination.

17. General

These Terms are the entire agreement between you and KeepCare about the Service. If any part is found unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor in connection with a merger, acquisition or sale of assets. Nothing in these Terms creates a partnership, agency or employment relationship.
